BoatingWise Terms of Use

1. Introduction
Welcome to BoatingWise! We connect boaters (“Customers”) seeking boating services or assistance with qualified professionals (“Providers”), creating a platform where Customers can find, contact, and review Providers who have passed our vetting checks. We (collectively, “BoatingWise,” “we,” “us,” or “our”) operate this website and related applications and services (together, the “Platform”).
Please read these Terms of Use (“Terms”) carefully before using our Platform. By using or accessing our Platform, you agree to these Terms. If you do not agree, please stop using the Platform immediately.
2. Who We Are
BoatingWise Ltd. operates the Platform to help match Customers with vetted Providers.
“You” or “User” means you, whether you are a Customer looking for a boating service or a Provider offering such services.
Important Points:
BoatingWise’s role is limited to operating this Platform as an intermediary.
We are not responsible for the quality, standard, or delivery of any services provided by Providers, nor for any arrangements or contracts between Customers and Providers.
3. Using Our Platform
Eligibility. You must be at least 18 years old to use our Platform. By using our Platform, you confirm you are 18 years or older.
Account Creation. Certain Platform features require you to register an account. You agree to provide accurate, truthful information and keep it up to date. You must safeguard your account credentials. You are responsible for any activity under your account.
Vetting and Checks. We may conduct checks on Providers (including verifying credentials, insurance, or qualifications), but we do not guarantee completeness, accuracy, or continued coverage. You are encouraged to verify a Provider’s details directly before proceeding with their services.
User Conduct. You agree to use the Platform only for lawful purposes and in compliance with these Terms and all applicable laws. You must not abuse, harass, or harm other users or post inappropriate or illegal content.
4. Our Service Role
Introduction Only. BoatingWise helps Customers discover and engage with Providers but is not a party to any contract between a Customer and a Provider.
No Guarantee. We do not guarantee the ability of Providers to perform services or the availability, reliability, or suitability of any services offered. We do not endorse or recommend any specific Provider.
Disputes. If a dispute arises between a Customer and a Provider, both parties release BoatingWise from all claims, damages, or demands connected with such a dispute. We are not liable for any agreements entered into between you and a third party via the Platform.
5. Your Content and Reviews
Posting Content. You may post or upload text, images, reviews, or other materials (“Your Content”) to the Platform. By doing so, you warrant:
You own or have necessary rights to Your Content.
It does not violate any law, infringe third-party rights, or contain defamatory, offensive, or misleading material.
License. You grant BoatingWise a worldwide, non-exclusive, royalty-free license to use, display, distribute, and create derivative works from Your Content for our business purposes.
Reviews. If you provide a review, it must reflect your genuine experience. You must not post fake reviews or manipulate the Platform’s review features. We may remove any content or reviews that breach these Terms or any policies we publish.
6. Intellectual Property
Our IP. All trademarks, logos, and content on the Platform (other than Your Content) are owned or licensed by BoatingWise. You have no rights to use them without our prior written permission.
Prohibited Uses. You must not copy, reverse-engineer, or redistribute any part of our Platform other than as expressly permitted by these Terms.
7. Privacy and Cookies
Privacy. Your personal information will be collected, used, and stored in line with our Privacy Notice (available on our website). By using the Platform, you acknowledge that any data we collect will be handled as described in our Privacy Notice.
Cookies. We use cookies and similar technologies to help operate and improve the Platform. See our Cookie Policy for details on how and why we use them.
8. Availability and Changes
No Guarantee. We aim to keep the Platform running smoothly but do not guarantee it will always be uninterrupted, secure, or error-free.
Updates. We may update or modify the Platform at our discretion and without prior notice. If we decide to discontinue certain features, we will try to notify you in advance where possible.
Termination. We reserve the right to suspend or terminate your account or access to all or part of the Platform at any time if:
We suspect a breach of these Terms.
You use the Platform unlawfully or misuse our services.
We decide to discontinue the Platform entirely.
9. Disclaimer and Liability
Disclaimer. Except where prohibited by law, the Platform is provided “as is” and “as available,” without warranty of any kind. To the extent permitted by law, we disclaim all warranties regarding the Platform and services offered by Providers.
Limitation of Liability. To the fullest extent permitted by law, BoatingWise’s total liability to you for any loss or damage arising out of these Terms or your use of the Platform shall not exceed fifty pounds (£50). We do not exclude liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.
Customer-Provider Relationship. Any contract for services is solely between you and the Provider. BoatingWise has no control over the fulfillment or quality of those services and will not be liable for any loss or damage related to them.
10. Miscellaneous
Modifications. We may modify these Terms at any time. If we make material changes, we will notify you (e.g., by email or via the Platform). Your continued use after changes are posted indicates acceptance.
Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
No Waiver. Our failure to enforce any provision of these Terms does not waive our right to do so later.
Governing Law. These Terms are governed by the laws of England and Wales. You can bring legal proceedings related to these Terms in the courts of England and Wales (or, if you live in Scotland or Northern Ireland, in the courts of your home country).
No Third-Party Rights. Only you and BoatingWise have rights under these Terms; no third party may enforce them.
